Rerun: INEC to fix Anambra Central election’s date

The Independent National Electoral Commission (INEC) may fix date for the Anambra Central senatorial rerun election this week. The election was nullified by the Court of Appeal in 2015, which ordered INEC to conduct e a fresh election to fill the vacancy.

Court cases had stopped the commission from conducting the rerun, but INEC’s, Professor Mahamood Yakubu, at a media interaction yesterday, said commission was working for the withdrawal of the cases so as to allow for alternative dispute resolution mechanism to resolve the matter.

The All Progressive Grand Alliance (APGA) candidate in the election, Chief Victor Umeh, said the INEC chairman was misled to believe there were pending court cases.

According to Umeh, “there are no pending cases from any political party qualified to participate in the rerun.” He said the pending cases were filed by the Peoples Democratic Party (PDP), which was affected by the judgement of the Court of Appeal. PDP was declared winner of the 2015 election, and according to the Electoral Act, the party was not qualified to participate in the rerun.

Umeh asserted that the Court of Appeal judgement was affirmed by the Supreme Court, and as such “have lost locus standi to be in court for any reason in respect of the Anambra Central senatorial election.” Umeh continued: “United Progressives Party (UPP) and Mega Peoples Progressive Party (MPPP) did not file any suit challenging the conduct of the election.

They were both hired by the PDP to file applications to be joined in the appeal against the judgment of the Federal High Court which ordered that PDP should be included in the rerun election in clear breach of the judgments of the Court of Appeal and the Supreme Court.”
